(A) All excavations set forth in § 154.26, except as herein exempted, shall require an Institutional Controls Program permit from the District. Applications for such permits shall be available at the Health District office, Kellogg, Idaho. This requirement shall not apply:
(1) To excavations of less than one cubic yard of earthen material;
(2) To excavations in a remediated area which does not penetrate the visible delineation lines between remediated and unremediated soil (this barrier is at approximately one foot in lawn areas and two feet in garden areas) and which do not reduce the depth of the barrier; or
(3) To areas which have been totally remediated.
(B) If an Institutional Controls Program permit is required, such permit must be approved and issued by the District prior to excavation.
