§ 113.09 EXEMPTIONS.
   The following exemptions apply to the requirements of this chapter. Unless otherwise provided by law, this chapter is not intended to restrict or prohibit the activities of the city or its agents.
   (A)   Exemption from concessions permit. The following are exempted from obtaining a permit to operate mobile concessions within the city, but are otherwise required to comply with all other provisions of this chapter:
      (1)   Vendors operating mobile concessions as part of a festival or event for which the festival or event director has previously obtained a waiver of the permitting requirements contained in this chapter from the City Council. Vendors operating pursuant to this exemption may also be granted relief from operating within the geographical area boundaries outlined in § 113.08; and
      (2)   Vendors engaged solely in the sale of farm or garden products produced or made personally by the vendor.
   (B)   Exemption from background check requirement. Any vendor or employee of the vendor, having successfully passed a background check pursuant to a permit application under this chapter, shall be exempt from resubmitting an additional background check for a period of five years; and
   (C)   Other exemptions. Any vendor may petition the City Council and, upon good cause shown, the City Council may, in its sole discretion, exempt the vendor from any or all of the background check, application fee, insurance, or permitting requirements under this chapter.
