For the violation of any of the following provisions of this franchise, penalties shall be chargeable to the letter of credit as follows.
(A) For failure to complete system construction in accordance with § 112.17 of this chapter unless the Town Council specifically approves the delay by motion or resolution due to the occurrence of conditions beyond the grantee’s control, the grantee shall pay a sum pursuant to the Appendix: Fines and Penalties in Ch. 31 of this code of ordinances, each day or part thereof the deficiency continues.
(B) For failure to provide data, documents, reports, information or to cooperate with Town during an application process or CATV system review, the grantee shall pay a sum pursuant to the Appendix: Fines and Penalties in Ch. 31 of this code of ordinances, per day each violation occurs or continues.
(C) For failure to test, analyze and report on the performance of the system following a request pursuant to this franchise, the grantee shall pay to Town a sum pursuant to the Appendix: Fines and Penalties in Ch. 31 of this code of ordinances, per day for each day or part thereof that such non- compliance continues.
(D) Forty-five days following adoption of a resolution of the Town Council determining a failure of the grantee to comply with operational maintenance standards, the grantee shall pay to the Town a sum pursuant to the Appendix: Fines and Penalties in Ch. 31 of this code of ordinances, per day for each day or part thereof that such non-compliance continues.
