(A) (1) All offices of the City of Wake Village, Texas, except members of the governing body, shall hereafter be filled by appointment as hereinafter provided.
(2) The elected offices shall be filled by appointment by majority vote of the City Council.
(3) Nothing in this division (A) shall be construed to prevent the governing body of the city from exercising its power to confer upon any officer additional duties or combine duties of offices as otherwise provided by law.
(B) (1) All members of the Police Department, including the Chief of Police, shall hold their employment at the pleasure of the City Council and shall have no continued expectation of employment as that term is used in the law of the State of Texas. All the police officers and Police Chief may be removed without cause.
(2) The person serving as the City Engineer shall serve in the capacity of an independent contractor, and not an officer or employee of the city. The City Engineer shall continue to have such authority as required in the performance of his or her contract, and shall continue to be designated the City Engineer for such purposes as are required by the law of the State of Texas, governmental agencies, contractors doing business with the city, bonding and insurance requirements, and other similar necessary purposes.
(3) The person serving as the City Attorney shall serve in the capacity of an independent contractor, and not an officer or employee of the city. The City Attorney shall continue to have such authority as required in the performance of his or her contract, and shall continue to be designated the City Attorney for such purposes as are required by the law of the State of Texas, governmental agencies, contractors doing business with the city, and other similar necessary purposes.
(4) All the officers, independent contractors, and police officers serving the city, as have been designated in this section, and the City Secretary and all department heads, shall be selected by the Mayor, as part of his or her lawful duty, with the advice and consent of the City Council, any such appointment requiring a two-thirds vote of the City Council.
(5) Any such department head, independent contractor, or police officer may be terminated by the Mayor with a two-thirds vote of the City Council or by a two-thirds vote of the City Council without the consent of the Mayor. All officers of the city shall be terminated in accordance with the provisions of the personnel policy and the law of the State of Texas.
