§ 94.03  PROHIBITION IN PUBLIC PLACES.
   Smoking shall be prohibited in all enclosed public places within the city, including but not limited to the following places:
   (A)   Any public facility, place, building, or vehicle where minors are permitted to enter or ride;
   (B)   Aquariums, galleries, libraries, museums and zoo facilities and grounds;
   (C)   Areas available to and customarily used by the general public in businesses and nonprofit entities patronized by the public, including but not limited to attorneys’ offices and other professional offices, banks, laundromats, hotels, and motels;
   (D)   Convention facilities;
   (E)   Elevators;
   (F)   Facilities primarily used for exhibiting any motion picture, stage drama, lecture, musical recital, or other similar performance; however, smoking which is a part of a stage performances is permitted;
   (G)   Health care facilities, except bed space facilities where smoking is ordered by an attending physician in keeping with the guidelines established by the facility;
   (H)   Licensed child care and adult day care facilities;
   (I)   Lobbies, hallways, and other common areas in apartment buildings, condominiums, trailer parks, retirement facilities, nursing homes, and other multiple-unit residential facilities;
   (J)   Polling places;
   (K)   Public transportation facilities, including buses, bus terminals, taxicabs, train stations, airports and other facilities and means of public transit under the authority of the city, as well as ticket, boarding, and waiting areas of public transit depots;
   (L)   Restaurants;
   (M)   Restrooms, lobbies, reception areas, hallways, and other common-use areas;
   (N)   Retail stores;
   (O)   Every room, chamber, places of meeting or public assembly, including school buildings under the control of any board, council, commission, committee, including joint committees, or agencies of the city or any political subdivision of the state during the time that a public meeting is in progress, to the extent the place is subject to the jurisdiction of the city;
   (P)   Service lines;
   (Q)   Shopping malls;
   (R)   Sports arenas and convention halls, including bowling facilities and outdoor arenas;
   (S)   The living area and offices of the Wake Village, Texas, fire station;
   (T)   Concession stands; and
   (U)   Training facilities that house residents in private and group rooms.
