(A) No person or entity shall operate a business or system to handle refuse from or in the city, except after applying to the City Council and receiving a certificate of need and proof that the city’s requirements for refuse handling are not being reasonably met by current ordinances, contracts, and approved contractors.
(B) As a prerequisite to applying for a certificate of need and being granted a contract or right to handle refuse, each such proposed contractor will submit certified financial statements showing assets and resources, financial and non-financial, sufficient to satisfy the City Council that the proposed contractor is able to perform the contract; proof of compliance with all federal and state laws and regulations; certificates of proposed services and rates; a statement of experience in handling refuse; certificates of workers’ compensation insurance and public liability insurance with minimum limits of as provided by a fee schedule maintained by the City Secretary, adopted by the City Council from time to time, for personal injury and as provided by a fee schedule maintained by the City Secretary, adopted by the City Council from time to time, for property damage; agreement to hold the city harmless from any liability for operations of the contractor; agreement to provide such services as are ordered by the city; and sufficient proof that the refuse handling needs of the city are not being met by the current contractor(s).
