§ 50.02  FURNISHING OF WATER, SEWER, OR OTHER CITY SERVICES OUTSIDE THE CITY LIMITS TO CEASE.
   (A)   The expressed policy of the City Council is not to provide any additional city-furnished services to include water or sewer services outside of the city limits, and to terminate those services being furnished in a prompt and equitable manner.  This section shall not apply to the firefighting or police services provided outside of the city, pursuant to inter-city and county agreements presently existing.
   (B)   The City Council has expressly agreed with the City of Texarkana, Texas to provide water and sewer services to the Belmont Addition and to the K-Mart Store, both within the city limits of the City of Texarkana, Texas, and will continue to do so under those agreements. Those customers are specifically excepted from the terms and conditions of this section, but remain subject to all other ordinances of the City of Wake Village, Texas concerned with the supply of utility and quasi-utility services.
   (C)   In the case of any existing services being rendered, or the agreement by the City Council to a variance to this section, the city will require inspections by the City Inspector of all plumbing, electrical and other services, and the issuance of permits, and shall require as a further condition that all of the structures and improvements adhere to the city codes and ordinances in all respects, and continue to adhere to such codes and ordinances, unless additional variances are granted.
   (D)   All water and sewer customers located outside of the city limits are to be notified of the passage of this section, and of its contents, by certified mail, return receipt requested, by the City Secretary, but shall be bound by the terms of this section from the date of its passage.
   (E)   Any agreements, customs, understandings, contracts, or other methods under which water or sewer services are being furnished outside of the city limits or have been furnished, or are proposed to be furnished, shall terminate on the following:
      (1)   Any change in ownership, rental, lease, or occupancy of any premises served;
      (2)   Any change in use of the premises served, whether the change in use increases, decreases or does not affect the amount of water served;
      (3)   Any failure of the property owner or occupier to adhere to the terms of this section, or voluntarily to allow the enforcement of the terms of this section;
      (4)   Failure to pay any bills, assessments, or other amounts due the City of Wake Village for any reason;
      (5)   Any use of water or sewer services in connection with, attributable to, in support of, or that otherwise contributes to the violation of any ordinance, resolution, law, statute, or other requirement of the City of Wake Village, Texas, the State of Texas, or the United States, on the premises, whether enforceable by the city or not;
      (6)   Any nuisance, misuse of water or sewer, unsanitary conditions, illegal activities or excess use of water; or
      (7)   Any other act or omission under which city customers’ services are terminated; and all meters, taps, hookups and other methods of obtaining services shall be removed in accordance with the ordinances regarding the termination of services within the city.
   (F)   It is the further expressed policy that the provision of water and sewer services outside of the city limits is a privilege and had been in the past extended to residences and to businesses providing beneficial, advantageous, and necessary services and goods, who cannot otherwise obtain satisfactory water and sewer services or be annexed to the City of Wake Village.
   (G)   The provision of such services shall be reviewed on a continual basis, and may be terminated for violations of this section and policy on notice to the customer, with a provision for a reasonable time to obtain alternate sources of water or sewer services, not to exceed 30 days.
   (H)   Rates for all such water and sewer services provided outside of the city shall be set by resolution of the City Council as for rates within the city, and may differ from the in-city rates.
