12-4-1: PROTECTED TREES:
   A.   Tree Cutting And Removal: Within the territorial limits of the Village no person shall, without first obtaining a permit, remove or relocate to any other site a tree or trees as described herein.
      1.   Any tree with a trunk diameter of six inches (6") or greater, DBH, located in a "mature woodland" as defined by Section 10-2-3 of this Code, and which is subject to the natural resource protection standards for forests provided for in subsection 10-5-3E of this Code.
      2.   Any tree with a trunk diameter of three inches (3") or greater, DBH, located in a "young woodland" as defined by Section 10-2-3 of this Code, and which is subject to the natural resource protection standards for forests provided for in subsection 10-5-3E of this Code.
      3.   Any other protected tree within the territorial limits of the Village having a trunk diameter of ten inches (10") or greater, DBH.
   B.   Assaults On Trees:
      1.   No tree identified above shall be deliberately or accidentally damaged or injured including damage or injury caused by the operation of construction or maintenance machinery or motor vehicles.
      2.   No wires, cables, lights, signs or similar items may be attached to any tree located in the public right of way or on public land except by permission of the Village or the public agency owning the land upon which the tree is located.
      3.   Where a tree is damaged so as to be unsafe, as determined by the Village Forester, it shall be removed and replaced in accordance with the replacement standards of Section 12-4-4 of this Chapter, by the person causing the damage or injury. (Ord. 97-473, 4-1-1997)
