A. Weight Restrictions: It shall be unlawful to drive any truck (every motor vehicle designed, used or maintained primarily for the transportation of property) with a gross weight, including the vehicle and load, in excess of twelve thousand (12,000) pounds or with a class F or heavier license plate on any road within the village which is within its jurisdiction except as otherwise permitted.
B. Permitted Vehicles: The prohibition in subsection A of this section shall not apply to fire, police or other emergency vehicles, village owned vehicles, school buses, public transit vehicles, garbage trucks on scheduled routes within the village or public utility vehicles. In addition, this prohibition shall not apply to trucks which exceed the above weight limit provided that the driver has a valid bill of lading for a delivery or pick up to a residence, business or construction site within the village and the truck traverses those village roads which are reasonably necessary for ingress or egress to that destination and provided that the truck shall use nonvillage roads whenever practicable. C. Overnight Parking: No truck with a gross weight, including vehicle and load, in excess of twelve thousand (12,000) pounds shall be parked in view of the public overnight in any area which is zoned residential within the village. This prohibition shall apply to all properties that are zoned SD, SE, SR or any other residential zoning district which may hereafter be created. (Ord. 2002-612, 10-15-2002, eff. 1-15-2003)
D. Limitation Exceptions: The limitations contained in subsection B of this section shall not apply to truck traffic on Delany Road, Yorkhouse Road, Kilbourne Road, Wadsworth Road, U.S. Route 41, Dilleys Road south of Wadsworth Road, Route 173 and that portion of Adams Road perpendicular to and easterly of Delany Road for a distance of two thousand two hundred (2,200) linear feet. As to these roads, no person shall drive any motor vehicle with a weight, including load, in excess of that permitted by applicable state law for driving on improved highways or with its weight distributed in a manner not conforming with applicable state law. E. Local Class II Truck Routes:
1. A class II truck route is hereby established for a distance of point three (0.3) mile on that portion of Adams Road between Delany Road easterly to, and westerly of, and not including, the bridge on Adams Road.
2. A class II truck route is hereby established on that portion of Delany Road between Illinois Route 173 to a point one point five (1.5) miles north of said intersection of Delany Road and Illinois Route 173.
F. Penalty: Any violation of this section shall subject the violator to the penalties set forth in section 1-4-1 of this code. (Ord. 2006-709, 10-17-2006)
