5-2-2: CURFEW:
   A.   Established: It shall be unlawful for any child under the age of seventeen (17) years to be on any public street in the Village between the hours of eleven o'clock (11:00) P.M. and six o'clock (6:00) A.M. from Sunday through Thursday inclusive and between the hours of twelve o'clock (12:00) midnight and six o'clock (6:00) A.M. on Friday and Saturday unless accompanied by or in charge of a parent or guardian or other proper companion of the age of twenty one (21) years or more unless engaged in some occupation or business in which such child may engage under the laws of this State.
   B.   Parental Responsibility: It is hereby made unlawful for any parent, guardian or other person having the legal care and custody of any person under seventeen (17) years of age to allow or permit any such child, ward or other person under such age to go, or be in or upon any of the streets, alleys or public places within the time prohibited or unless accompanied as herein provided or unless there exists a reasonable necessity therefor.
   C.   Notice Of Violation: Any child under the age of seventeen (17) years who violates this Section shall be warned by any police officer forthwith to comply with such provisions and such officer shall also, without delay, report such violation to such officer's superior officer, who shall cause a written notice to be served upon the parent, guardian, custodian or other person in control or charge of such child, setting forth the manner in which this Section has been violated. In case any child under the age of seventeen (17) years, after such warning, shall again violate any of the provisions of this Section, such child shall be apprehended as a juvenile delinquent and brought before the Circuit Court of Lake County to be dealt with accordingly.
   D.   Confinement: No child or minor person arrested under the provisions of this Section shall be placed in confinement until such child has been taken home to ascertain the parents' wishes and the parents shall have refused to be held responsible for the observance of this Section.
   E.   Violation After Notice: In case any parent, guardian or person in control or charge of such child who has received notice as provided herein shall knowingly permit such child again to violate the provisions of this Section, such parent, guardian, custodian or person in control or charge of such child shall be subject to the penalty provided for violation of this Section.    F.   Penalty: Any violation of this Section shall subject the violator to the penalties set forth in Section 1-4-1 of this Code. (1996 Code)
