(A) Mobile food vendors are prohibited from parking or operating upon any roadway within the City or within municipal parking areas, within any public right-of-way, park, trail or other public lands, without first receiving an approved Solicitors License from the Director of Public Safety or his/her designee and for municipal parking areas, additional authorization from the Director of Public Service and for parks and trails, additional authorization from the Assistant Director of Public Service, except as permitted pursuant a special event permit or other city issued permit authorizing the same.
(B) Mobile food vendors with a valid solicitors license shall be permitted to only park and operate upon public property within the Central Business Development District (CBDD) pursuant to the requirements and exceptions contained in this chapter and the following additional restrictions:
(1) Parking spots. A mobile food vendor consisting of a motor vehicle or trailer shall only occupy two marked parking spaces when operating in the CBDD. The mobile food vendor or trailer shall be positioned so that customers are only served on the curb side of the vehicle or trailer.
(2) Sidewalk pedestrian and bicycle traffic. Mobile food vendor operations shall not unreasonably obstruct pedestrian or bicyclist's passage along any sidewalk, street, alley, public right-of-way, public lands or parking lot by causing a congregation of people, that may endanger the health, safety or welfare of users of the public right-of-way, area or lands.
(3) Only mobile vendors using pushcarts are permitted to operate on sidewalks. A pushcart is a non-motorized wheeled conveyance, capable of being moved and positioned by one person. Umbrellas may be attached to any pushcart; however awnings or tents are prohibited. Tables and seating are not permitted. A pushcart operator must provide for a waste receptacle within ten feet of his/her operation and is permitted to have one free standing business sign or menu board not to exceed 48 inches tall by 24 inches wide. Pushcarts may not block access to any public fixture or fire hydrant and must be located along the curb line of any sidewalk.
(4) All mobile vendors must adhere to the following proximity restrictions:
(a) Allow a minimum of four foot for passage on sidewalks around mobile vending operations.
(b) Allow for 20 feet of separation from a customer entrance to restaurants, cafes or eating establishments and any outdoor dining areas (measured from the closest dining location) unless written permission has been granted by the restaurant, café or eating establishments owner/operator to be closer than 20 feet and said written permission is submitted with the solicitor license application. This restriction shall only apply when the restaurant is open for business.
(c) Allow for ten feet of separation from the entrance or exit of banks, and the location of ATMs, fire hydrants, crosswalks, handicap parking spaces, bus stops, public seating, benches or other public fixtures and private and public driveways and shall maintain at a minimum a ten foot separation from other mobile vendors.
(C) The city may designate a specific municipal parking area location for all public property mobile vending requests at its discretion.
(D) All private property mobile vending requests shall be governed by the temporary transient commercial sales regulations contained in the city's zoning code and referenced ordinances, rules or regulations.
