(A) The owner or tenant of property abutting a public sidewalk whereon there is a retaining wall or other structure shall keep the same in good repair so as not to endanger the public safety.
(B) Whoever violates this section is guilty of a minor misdemeanor for a first offense; for a second or subsequent offense within one year of the first offense such person is guilty of a misdemeanor of the first degree for each such offense.
