(A) No person shall operate an “all purpose vehicle” or “snowmobile” upon any public street, alley or sidewalk or on property open to the public for vehicular traffic. It shall be an affirmative defense that the operation was as part of a parade or while being loaded onto or unloaded from another vehicle or when the Director of Public Safety has issued a declaration that the use of “all purpose vehicles” or “snowmobiles” is permissible due to emergency conditions.
(B) As used in this section, the terms “all purpose vehicle” and “snowmobile” shall have the same meanings as defined in the Ohio Revised Code.
(C) Whoever violates this section is guilty of a minor misdemeanor. If an offender persists in violation of this section after reasonable request to desist by a law enforcement officer, then a violation of this section is a misdemeanor of the first degree.
