§ 35.04 PAID HOLIDAYS.
   (A)   Paid holidays for city employees, other than those for whom paid holidays are specified in a collective bargaining agreement and employees scheduled to work more than an eight- hour shift on a regular basis shall be as follows:
      (1)   The first day of January, known as New Year’s Day;
      (2)   The third Monday in February, known as Washington-Lincoln Day;
      (3)   The last Monday in May, known as Memorial Day;
      (4)   The fourth day of July, known as Independence Day;
      (5)   The first Monday in September, known as Labor Day;
      (6)   The eleventh day of November, known as Veterans Day;
      (7)   The fourth Thursday in November, known as Thanksgiving Day;
      (8)   The day after the fourth Thursday in November, known as the day after Thanksgiving Day;
      (9)   The twenty-fourth day of December, known as Christmas Eve; and
         (10)   The twenty-fifth day of December, known as Christmas Day.
   (B)   The observance of Veterans Day shall begin in the calendar year 2013.
   (C)   In the event that a holiday listed in division (A) of this section falls on a day an employee is not scheduled to work, the employee is entitled to an additional day off in lieu thereof, which shall be the preceding Friday or the following Monday after the holiday, as determined by the Mayor.
   (D)   Overtime eligible full-time employees who are scheduled to work on the above holidays shall be paid for regular hours for the holiday (i.e., eight hours for 40-hour employees; seven hours for 35-hour employees), plus payment for those hours actually worked on the holiday at one and one-half times the regular rate of pay.
   (E)   Overtime eligible full-time employees who are not scheduled to work on the above holidays, but are called to work, shall be paid for regular hours for the holiday (i.e., eight hours for 40-hour employees; seven hours for 35-hour employees), plus the applicable call-in pay.
   (F)   Overtime eligible employees who use sick leave for one entire shift or any portion of a shift either prior to or following the holiday will forfeit the holiday pay unless the employee provides a satisfactory, signed statement from a licensed physician or dentist to justify the use of sick leave. The appointing authority may excuse an employee from this provision when extenuating circumstances so warrant.
   (G)   Employees scheduled to work more than an eight hour shift on a regular basis shall be entitled to eight hours of paid holiday leave per year effective the first day of each calendar year. The scheduling of said paid holiday leave shall be subject to the approval of the department head considering the staffing needs of the department and other holiday, vacation and sick leave requests. Said paid holiday leave cannot be used in less than eight hour increments. Employees who do not utilize paid holidays or are unable to utilize such holidays due to the needs of the department shall be paid for such remaining unused holidays in the first pay period of December each year by separate check.
