(A) The Shade Tree Commission shall have the power to study, investigate, plan, advise, report and recommend to Council, the Director of Public Service or the Mayor any action, program, plan or legislation which the Commission shall find or determine to be necessary or advisable for the care, preservation, trimming, planting, replanting, removal or disposition of trees and shrubs in public ways, streets and alleys.
(B) The Shade Tree Commission shall advise the Council and Director of Public Service or Mayor regarding plantings in cul-de-sac islands and other non-traditional public right of way spaces such as boulevard or other public ways. The Shade Tree Commission and city shall have no responsibility for plantings, maintenance or removal of plantings in cul-de-sac islands unless deemed a nuisance as defined in § 96.01.
