Any person having any record title or legal interest in the building may appeal from any action or decision of the Building Official under this title by filing an appeal in writing to the planning commission as provided in Visalia Municipal Code Section 17.28.050. Failure of any person to file an appeal in accordance with Section 17.28.050 shall constitute an irrevocable waiver of the right to an administrative appeal.
The Building Official may collect and require a separate appeal fee. The applicable appeal fee shall be set by separate city council resolution passed in accordance with state and local law, the fee shall be set at a rate sufficient to recover the city costs incurred to conduct such an appeal. If the fee is required, then no appeal shall proceed without payment of the fee or without the applicant requesting and being granted a fee waiver pursuant to the granting of a hardship waiver in accordance with Visalia Municipal Code Section 1.13.080.
