A. Insurance. Any person installing or maintaining a newsrack in the right-of-way of the district shall furnish to the director a certificate of insurance showing that such person has then in force a policy or policies of public liability insurance and property damage insurance, naming the city and its officers and employees as additional insureds and in an amount not less than one-hundred thousand dollars ($100,000) minimum liability combined single limit (bodily injury and property damage) per person and per occurrence.
B. Indemnification. Every person operating or maintaining a newsrack upon or within the public property, right-of-way or public easements within the district, shall agree prior to the granting of a permit, to indemnify and hold harmless the city, its officers and employees, from any loss, liability, damage, or costs sustained by any person or property, arising from the installation, operation or use of such newsrack.
