INTENT AND PURPOSE.
Regulating and planting and maintenance of trees and other woody vegetation on public and private property and establishing a City Tree Board.
For the purpose of this chapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
PARK TREES. Trees, shrubs, bushes and all other woody vegetation in public parks and all areas owned by the city or to which the public has free access as park.
STREET TREES. Trees, shrubs, bushes and all other woody vegetation on land lying between property lines on either side of all streets, avenues, boulevards or within city property.
TREE SIZES.
(1) LARGE TREE. Any plant material that will grow to a height of over 50 feet.
(2) MEDIUM TREE. Any plant material that will grow to a height of 50 feet.
(3) SMALL TREE. Any plant material that will grow to a height of 30 feet.
(A) Tree Board. The City Park Board is hereby designated as the City Tree Board.
(B) Members. Members of the Park Board shall hold office concurrently with their terms as Park Board members.
(C) Compensation. Members of the City Tree Board shall serve without compensation.
(D) Duties and responsibilities. It shall be the responsibility of the City Tree Board to study, investigate, counsel, develop and administer a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of trees and shrubs, in parks, along streets and in other public areas. The plan shall be presented to the Council and, following the review and approval by the Council, shall constitute the official comprehensive City Tree Plan. The Board, when requested by the Council, shall consider, investigate, make findings, report and recommend upon any special matter of question coming within the scope of its work.
(E) Officers. The Board shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall constitute a quorum for the transaction of any business. Nothing in this section shall be deemed to conflict with M.S. §§ 412.501 through 412.531, as they may be amended from time to time, respecting the operation of a municipal park board.
(A) Spacing. The spacing of street trees shall be in accordance with tree species size classes provided in this chapter, and no trees may be planted closer together than as follows: small trees, 30 feet; medium trees, 40 feet; and large trees, 50 feet; except in special plantings designed or approved by the City Forester or Engineer.
(B) Location. The distance trees may be planted from curbs or curblines and sidewalks shall be in accordance with the tree species size classes listed in § 13.01 of this chapter, and no trees may be planted closer to any curb or sidewalk than the following: small trees, two feet; medium trees, three feet; and large trees, four feet; unless approved by the City Forester or Engineer.
(C) Corners, fireplugs and driveways. No street tree shall be planted closer than 35 feet to any street corner, measured from the point of nearest intersecting curbs or curblines. No street tree shall be planted closer than 15 feet to any fireplug, nor five feet from any driveway.
(D) Utilities. No street trees other than those defined as “small trees” in § 13.01 of this chapter may be planted under, or within ten level feet of, any overhead utility wire; or over or within ten lateral feet of any underground water line, sewer line, transmission lines or other utility.
