(A) The Board shall have general policy making authority over the utilities owned by the City of Vincennes, specifically the Water Department of the City of Vincennes, the sewer collection system, the waste water treatment facility, and the storm sewer utilities, but shall not interfere with the detailed supervision of the superintendent, who is to be held responsible to such Board for the business and technical operation of the utilities. The Superintendent shall keep the Board, Mayor and Council informed of utilities activities, and shall provide whatever information is requested and make reports as required. The superintendent shall make an annual report concerning the operating and fiscal condition of the utilities to the Vincennes Common Council and shall submit a budget as prescribed under I.C. 8-1.5-3-4(a)(6).
(B) The Board shall select a superintendent who shall have executive charge of the city owned utilities. The Board may enter into a contract of employment with such superintendent upon terms it deems just and reasonable. In the appointment of a Superintendent the Board shall make the selection on the basis of fitness to manage, taking into account executive ability and knowledge of the utility industry.
(C) The Board shall fix the compensation of all employees, including the Superintendent. No persons other than utility employees shall be paid a salary from utilities funds except as enacted in a Salary Ordinance.
(D) The Board shall adopt rules and regulations governing the appointment of all employees, making proper classifications, such rules to determine the eligibility of applicants. All rules regulating employment shall be consistent with all existing citywide personnel policy, including equal employment and affirmative action practices. The Superintendent shall have the right to discharge employees at will, but shall be required to state the cause.
(E) The Utilities Service Board shall implement and enforce a policy for the sewer and water utilities that sewer and water connections shall not be made to any areas beyond the corporate limits of the City of Vincennes unless and until the landowners execute and record a covenant running with the land to be served not to oppose or remonstrate against any proposed annexation of the real estate served by the City of Vincennes. Such covenant to bind the current and future owners of the real estate to be served.
