All stormwater service fees become delinquent if not paid on or before the thirtieth day after the date on the quarterly fee charge statement. On that date a penalty of 10% of the delinquent fees shall be attached to the delinquent fee, and if the fees are collect pursuant to a civil action the City may recover its reasonable attorney fees (I.C. 36-9-23-31). If fees are more than 90 days delinquent then the City may enforce the delinquent stormwater service fees by utilizing the lien process set forth in I.C. 36-9-23-32 through 34. In addition to establishing its claim for the delinquent fees and penalty in filing for the lien, the City shall seek from the property owner a $5 service charge and the recording and release fees charged to the City by the County.
