§ 91.09 CITATIONS.
   (A)   The Animal Control Warden of the county may issue citations to the owners of dogs for violations of §§ 91.04, 91.05 or 91.06 in lieu of impounding the dog.
   (B)   When such a citation is issued, an appearance date of not less than ten days and not more than 45 days shall be entered by the officer on the citation.
      (1)   First offense. The owner of the dog subject to the citation may plead guilty to the offense charged in the citation prior to the scheduled appearance date by so indicating on the citation and paying a fine of $50 at City Hall without formal court appearance prior to the date appearing on the citation. Unpaid fines and/or challenges to a violation resulting in court appearances will include the fine fee, plus court costs payable by the dog owner if found guilty of the violation.
      (2)   Second offense. A second violation by the same owner shall be punishable by a fine of $200, payable to City Hall, without formal court appearance prior to the date appearing on the citation. Unpaid fines and/or challenges to a violation resulting in court appearances will include the fine fee, plus court costs payable by the dog owner if found guilty of the violation.
      (3)   Third or subsequent offense. A formal court appearance shall be required for third and subsequent violations, which shall be punishable by a fine not less than $400, nor more than $600, plus court costs.
