(a) No person shall discharge or cause to be discharged any unpolluted waters such as stormwater, groundwater, roof runoff, subsurface drainage or cooling water to any sanitary sewer.
(b) Unless noted otherwise herein, the substances, materials, waters, or wastes described in subsection (c) hereof are prohibited from discharge to the sewer system.
(c) Where the discharge of a noted substance, material, water, or waste is permitted, it shall be limited in the characteristics of its discharge to the sewer system to concentrations, quantities or characteristics which will not harm either the sanitary sewers, the wastewater facilities, the POTW treatment plant, or the Department of Public Works or POTW treatment plant personnel, will not have an adverse effect upon any receiving stream, or will not otherwise endanger lives, limb, public property, or constitute or create a public nuisance. Furthermore, no individual, person or User may discharge any of the following to the sewer system outside of the limitations or restriction on materials set forth herein without approval of the Control Authority:
(1) Any liquids, solids or gases which by reason of their nature or quantity are or may be sufficient, either alone or by interaction or in combination with other substances present, cause a fire or an explosion or be otherwise injurious to the sewer system or POTW treatment plant, to the operation of the sewer system or POTW treatment plant, or to the personnel of the Department of Public Works or POTW treatment plant. At no time shall a discharge of pollutants present or create a fire or explosion hazard in the sewer system or at the POTW treatment plant, including, but not limited to, waste streams with a closed cup flashpoint of less than 140° (degrees) Fahrenheit or 60° (degrees) Centigrade using the test methods specified in 40 CFR 261.21. Pollutants subject to this section include, but are not limited to, gasoline, fuel oil, motor oil, kerosene, naphtha, benzene, toluene, xylene, ethers, alcohols, ketones, aldehydes, peroxides, chlorates, perchlorates, chromates, carbides, hydrides and sulfides.
(2) Solid or viscous substances which may cause obstruction or other interference with the operation of the sewer facilities or POTW treatment plant such as, but not limited to: grease, garbage containing particles greater than one-half (1/2") inch in any dimension, animal guts or tissues, paunch manure, bones, hair, hides or fleshings, entrails, whole blood, feathers, ashes, cinders, sand, spent lime, stone or marble dust, metal, glass, straw, shavings, grass clippings, rags, spent grains, spent hops, waste paper, wood, plastics, gas, tar, asphalt residues, residues from refining or processing of fuel or lubricating oil, mud or glass grinding or polished wastes.
(3) Wastewater discharged to the sewer system shall not contain more than 25 mg/L (milligrams per liter) of petroleum oil, non-biodegradable cutting oils, or products of mineral oil origin, nor shall it contain floatable oils, fat, or grease in excess of 500 mg/L. Garbage grinders may be connected to sanitary sewers only from homes, hotels, institutions, restaurants, hospitals, or similar places where garbage originates from the preparation of food in on-site kitchens for the purpose of consumption on the premises.
(4) Any wastewater having a pH less than 6.0 S.U. (Standard Units), or greater than 10.0 S.U., or wastewater having any other corrosive property capable of causing damage or hazard to structures, equipment, and/or personnel of the Department of Public Works or POTW treatment plant.
(5) Any wastewater containing toxic or hazardous pollutants, either solid, liquid, or gaseous in sufficient quantity, either singularly or by interaction with other pollutants to injure Department of Public Works or POTW treatment plant personnel or the general public, cause harm or interfere with any sewer system or POTW treatment plant process, constitute a hazard to humans or animals, create a toxic effect in the receiving waters of the POTW treatment plant.
A. A toxic pollutant shall include, but not be limited to, any pollutant identified pursuant to Section 307 (a) of the Act.
B. The discharge of any toxic or hazardous pollutant(s) shall not exceed the limitation(s) set forth in a Categorical Pretreatment Standard (40 CFR 405-471) or any other Pretreatment Standard.
(6) Any noxious or malodorous solids, liquids, or gases which either singularly or by interaction with other wastes are sufficient to create a public nuisance or hazard to life or are sufficient to prevent entry to the sewers for their maintenance and repair.
(7) Any substance which may cause the POTW treatment plant's effluent or any other product of the POTW treatment plant as residues, sludges, or scums, to be unsuitable for a reclamation process where the PUB is pursuing a reuse and reclamation program.
(8) In no case shall a substance discharged to the sewer system cause the City or POTW treatment plant to be in non-compliance with sludge use or disposal criteria, guidelines or regulations developed under Section 405 of the Act, any criteria, guidelines or regulations affecting sludge use or disposal subject to the Solid Waste Disposal Act (42 U.S.C. 6901, et. seq.), the Toxic Substances Control Act (15 U.S.C. 2601, et, seq.) or other applicable Federal regulations, or any State criteria, guidelines or regulations applicable to the sludge management method being used.
(9) Any substance which will cause the City or POTW treatment plant to violate water quality standards or designated uses of the receiving water as adopted by the State of West Virginia.
(10) Any wastewater with objectionable color not removed in the treatment process such as, but not limited to, dye wastes and vegetable tanning solutions.
(11) Any wastewater having a temperature which will inhibit biological activity in the POTW treatment plant resulting in interference, but in no case wastewater with a temperature which at the introduction into the sewer system exceeds 40° C (104° F).
(12) Any pollutants, including oxygen demanding pollutants (BOD, etc.), released at a flow and/or pollutant concentration which a User knows or has reason to know will cause interference to the sewer system or POTW treatment plant.
(13) In no case shall a "slug" load have a flow rate or contain concentration(s) or quantities of pollutants that exceed for any time period longer than fifteen (15) minutes more than five (5) times the average twenty-four (24) hour concentration, quantities, or flow which occurs during normal operation.
(14) Any wastewater containing any radioactive wastes or isotopes of such half- life or concentration as may exceed limits established by the Control Authority in compliance with applicable State or Federal regulations.
(15) Any water or waste with a BOD5 in excess of 300 mg/L (milligrams per liter) and/or any water or waste containing Suspended Solids in excess of 300 mg/L, on an average daily flow composite basis, unless the Control Authority determines the volume of such wastewater discharge to be sufficiently small as to result in mass loadings from the City to the POTW treatment plant within the City's allocated capacity at the POTW treatment plant. On a case by case basis, the Control Authority may determine that limitations less than 300 mg/L BOD and Suspended Solids, or appropriate limits for other pollutants, may be required to prevent excessive loadings to the sewer system.
(16) Any water or waste containing any of the pollutants listed in Section 925.10.3, or any other similar objectionable or toxic substances or pollutants to such a degree or extent that any such discharge exceeds the limit(s) established by the Control Authority for such materials.
(d) Grease, oil and sand interceptors shall be provided when, in the opinion of the Control Authority, they are necessary for the proper handling of liquid wastes containing grease in excess of amount provided in paragraph (c)(3), or any flammable wastes, sand, and other harmful ingredients; except that such interceptors shall not be required for private living quarters or dwelling units. All interceptors shall be of a type and capacity approved by the Control Authority, and shall be located as to be readily and easily accessible for cleaning and inspection.
(1) Grease and oil interceptors shall be constructed of impervious materials capable of withstanding abrupt and extreme changes in temperature. They shall be of substantial construction, watertight, and equipped with easily removable covers which when bolted in place shall be gas-tight and water-tight.
(2) Where installed, all grease oil and sand interceptors shall be maintained by the Owner, at his expense, in continuous operation at all times.
