432.35 "PEELING;" CRACKING EXHAUST NOISES.
   (a)    No person shall accelerate or cause to be accelerated any motor vehicle upon any public street, alley or right of way or on any private property in the City in such a manner as to cause the tires of the motor vehicle, upon movement of the motor vehicle, to squeal, peel, grind, scrape or leave tire markings upon the pavement or surface upon which the motor vehicle is operated.
 
   (b)   No person shall accelerate or cause to be accelerated any motor vehicle upon any public street, alley or right of way or on any private property in the City in such a manner as to cause the exhaust system of the motor vehicle to emit a loud, cracking or clattering noise unusual to the normal operation of a motor vehicle.

   (c)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
