There is hereby authorized and created, in the official City personnel classification and job authorization within the roster of employees of the City, a noncompetitive, nonclassified position known as ice breaker operator. Eight of such ice breaker operators are hereby authorized.
Such position shall be a part-time, seasonal and emergency position in the City with no fringe benefits, provided, however, that the Director of Finance is hereby authorized and directed to include such position within Workers' Compensation provisions of the State, if eligible, and/or as a position covered by public liability insurance of the City. The Finance Director is further authorized to pay any and all increases in premiums to provide for such coverages when available under law or under the extension or modification of existing policies of liability insurance of the City.
The Mayor is hereby authorized to appoint eight individuals to the position of ice breaker operator and, at his or her discretion, to remove such individuals. Such appointments shall be for an indefinite and continuous period of time until resignation, incapacity or removal by the Mayor. The powers and duties of such ice breaker operators shall include, but not be limited to, the operation of any and all vessels owned by the City during perilous times upon the Vermilion River; breaking of ice upon the Vermilion River; doing any and all acts necessary to protect and preserve life and property from the common enemy of flooding river waters and ice jams; and entering upon all areas in and around the Vermilion River and the area of the mouth of the River and Lake Erie to perform such heroic duty. If compensation is to be paid therefor, the same shall be established by the Mayor, with confirmation by Council. All ice breaker operators shall be directed by the Mayor and shall cooperate with the Director of Public Service in the performance of their functions. Such functions shall be considered an appendage to the civil disaster services rendered by the City.
