1083.01 PERMITS REQUIRED; APPROVAL; CONSTRUCTION REQUIREMENTS; FEES; DEPOSITS.
   (a)   Before installing any culverts or driveway drains along a roadside ditch within the dedicated portion of any public street or thoroughfare in the City, or within that portion of any real estate which is contained within an easement to the City for public street or thoroughfare purposes, the owner of the abutting property in which the culvert or drain will be placed shall first obtain written permission from the City Engineer to make such installation.
   The length and diameter of such culvert or drain and the depth and level of the same shall first be approved by the City Engineer and the installation of such culvert and drain shall be approved and inspected by the Director of Public Service or his or her representative.
   Every culvert pipe or driveway drain hereinafter installed in the dedicated portion of any public street or thoroughfare or within the area covered by an easement for street or thoroughfare purposes in the City shall be constructed of reinforced concrete or substituted by the following:
      (1)   High-density polyethylene pipe (meeting AASHTO M252 or M294) with soil tight gaskets (meeting ASTM F477) provided the following requirements are met:
         A.    Cover over the pipe shall meet the following requirements:
            1.    For installation under flexible pavement a minimum of one (1) foot of cover for pipe sizes 12” through 48” and a minimum of two (2) foot for pipe sizes 54” and 60” is required. The cover is to be measured from the crown of the pipe to the bottom of the flexible pavement.
            2.    For installation under rigid pavement a minimum of one (1) foot of cover for pipe sizes 12” through 48” and a minimum of two (2) foot for pipe sizes 54” and 60” is required. The cover is to be measured from the crown of the pipe to the top of the rigid pavement.
            3.   For any other installation a minimum of 18” of cover for pipe sizes 12” through 48” and a minimum of 30” for pipe sizes 54” and 60” is required.
         B.   Backfill material is to be #8 or #57 washed limestone. The pipe bedding is to be a minimum of 6” and the backfill is to be a minimum of 6” above the crown of the pipe.
         C.   For installation in areas of a high groundwater table additional cover or anchoring of the pipe will be required in order to prevent floating of the pipe. Approval of the City Engineer will be required in these circumstances.
      (2)   Solid wall SDR 35 PVC with joints meeting ASTM 3034 at least sixteen feet in length and at least twelve inches in diameter, and the flow line of the pipe or drain shall be at least eighteen inches in depth below the grade level of the street or shoulder, unless, in the judgement of the City Engineer, existing ditch conditions prevent such depth and diameter.
   (b)   No person shall construct, install, continue or connect any house sewer or drain within the lines of any street or other public way or ground without first obtaining a written permit from the Building and Zoning Inspector to do so and no such work shall be commenced or prosecuted unless such permit is upon the ground and in the possession of the person in charge of the work. The permit shall be granted after consent of the City Engineer and on the express condition that the owner or tenant for whose benefit such connection is made, and each succeeding tenant, shall, in consideration of the privilege thereby granted, hold the City harmless for any loss or damage that may in any way result from or be occasioned by such tap or connection.
   (c)   The fee for such permit shall be fifty dollars ($50.00). The permit shall be issued only after the applicant pays a deposit of five hundred dollars ($500.00) for pipe installation work done on tree lawns, which shall be refundable in whole or in part if the City Engineer approves the same not sooner than sixty days and not later than ninety days after completion.
   (d)   An additional deposit fee in the amount of one thousand, five hundred dollars ($1,500) shall be paid by the applicant if concrete and/or blacktop pavement is opened or excavated.
   (e)   In addition to the permit required by subsection (b) hereof, a permit to open any street or other public way or ground or remove any pavement therefrom for the purpose of constructing, installing, continuing or connecting any sewer or drain shall be obtained.

   (f)   Property owner is responsible for making repairs to any asphalt or concrete apron(s) which may have been removed by the City when replacing the culvert pipe.
   (g)   The City can provide all labor necessary for replacing the culvert pipe(s) per the specifications as outlined in this section or the City construction standards. The property owner will pay 90% of the cost of all improvements while the City of Vermilion will pay 10%.
   (h)   The property owner has the option to pay at the time of completion, or the option to have the total costs included in the their monthly utility bill, to be paid in full within 12 months from day of completion. The property owner will be notified by certified mail for non compliance as outlined in Section 1083.03.

   (i)   Work performed by the City of Vermilion will be charged by a per linear foot basis and will be calculated by the Service Director of the City of Vermilion.
   (j)   The property owner can pay for the work performed at the time of completion, or sign a Promissory Note, Exhibit A, with the City of Vermilion. Equal monthly installments will be included on the resident's utility bill for the services rendered by the City.
