632.09 FILING AND REPORTING REQUIREMENTS OF EMPLOYERS.
   (a)   Every employer shall:
(1)   File, in January of each year, with the office of the Director of Public Safety, who the Erie County Health Commission has designated to receive such filings, and update annually, a list of all work areas in the workplace where hazardous chemicals are manufactured, used or stored, specifying, subject to Section 632.14, by chemical name, all hazardous chemicals in each work area;
(2)   Immediately report to the office of the Director any information concerning any spill, leak, discharge or emission of any hazardous substance which is required to be reported to or filed with any Federal or State agency under applicable law, including, but not limited to, the Clean Air Act, the Clean Water Act, the Resource Conservation and Recovery Act and the Comprehensive Environmental Response Compensation and Liability Act;
(3)   File with the office of the Director a copy of any construction or operating permit, insofar as such permit sets forth conditions for or limitations on the discharge or emission of any hazardous chemical; and
(4)   Pay the appropriate annual filing fee to defray part of the cost of the regulatory program, including inspections.
   (b)   This section shall not apply to employers engaged in the business of construction or reconstruction, provided that such employers are in compliance with Section 632.10 and provided the quantity of any hazardous chemical manufactured, used or stored is less than fifty-five gallons of liquid, or the equivalent thereof in its solid or gaseous state, based upon generally accepted chemical measures, per workplace.
 
   (c)   Whoever violates or fails to comply with this section is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 698.02.
