(a) After the written and physical exams, a review of the applicants shall be scheduled, with a list of applicants considered to be eligible for the available position(s) prepared by the Clerk, listed by number. The review shall be by Mayor and Council in executive session. Council shall tally the written test scores and add any credit points the applicant is entitled to according to ordinance and list the applicants (by number) and their scores made. After the scores are tabulated the candidate names shall be revealed by the Clerk. Council shall then determine by vote, the applicants chosen to proceed to the remaining test procedures, and may choose up to ten candidates. (Psychological exam, Section 249.02(c) and a list made.) Determination of successful candidates shall include all the attributes stated in the purpose of this chapter and the effects of those attributes upon the community. After the psychological exam is completed, the Mayor and the Fire Chief shall interview all final candidates. (A conditional offer of appointment shall not be made until Council has reviewed all examinations in total.)
(b) (1) The final results of all tests shall be kept on file in the office of the Mayor. Whenever there is a vacancy, the Mayor shall appoint from the top ten candidates on the eligibility list. A person who has been considered for appointment by the Mayor from an eligible list more than two times to the same position shall be omitted from future consideration by the Mayor.
(2) Council shall review the list of remaining applicants and determine if the list is sufficient for appointment procedures. The eligibility list shall be effective only for the department for which the list was originally created and only for a period of two years from the initial written testing date unless the requirements of this chapter are revised within that time.
(3) Should a candidate refuse (in writing), for any reason, to accept appointment in the Fire Department when first offered by the Mayor, such candidate's name shall be removed from the eligibility list and such candidate shall be ineligible to be reinstated on such list. After the expiration of said eligible list, the candidate shall be eligible to reapply to take any subsequent exam for initial appointment in the Fire Department.
