10-1-6: DEFINITIONS:
 
ADMINISTRATOR:
That official of Valley County appointed by the board whose duties are to administer the Valley County subdivision ordinance, review all property splits, process applications for subdivisions, assist the general public, and coordinate with various agencies.
APPLICATION FOR APPROVAL FOR PRELIMINARY PLAT OR SUBDIVISION:
A form approved and issued by the commission and completed and filed by the subdivider. The subdivider shall certify the accuracy of information required.
APPLICATION FOR DEDICATION OF STREETS, OR GRANT OF RIGHT OF WAY EASEMENTS:
A form approved and issued by the commission and completed and filed by owners of property lying in the unincorporated portions of Valley County, which owners desire to dedicate, grant, or convey rights of way or easements over, across or under all or a portion of their property for benefit of the public. The owners shall certify the accuracy of information required.
APPLICATION FOR TOTAL OR PARTIAL VACATION OF AN EXISTING SUBDIVISION OR OTHER PUBLIC RIGHTS OF WAY:
A form approved and issued by the commission relating to a total or partial vacation of an existing subdivision or plat, right of way or easement. The applicant shall certify the accuracy of information required.
BLOCK:
A group of lots within defined and fixed boundaries, usually a parcel of land bounded by physical barriers, one or more streets, or a boundary line of a subdivision that has been legally surveyed and recorded.
BOARD:
The Valley County board of county commissioners.
BUILDABLE PARCEL:
A parcel or tract of land that was not created by violating the subdivision regulations or was of record prior to October 15, 1991, and has separate access to an existing street.
CITY:
Any incorporated municipality within Valley County.
COMMISSION:
The planning and zoning commission of Valley County.
COUNTY COMPREHENSIVE PLAN:
The plan, or coordinated policies and plans, in preparation or which have been adopted by the board for the social, physical and economic development of Valley County, intended among other things to encourage the most appropriate use of land, to indicate the general location and extent of desirable public facilities; and to provide a street system, coordinated with land use, for the safe, expeditious movement of vehicular and pedestrian traffic throughout the county or any portion thereof.
COUNTY ENGINEER:
The registered civil engineer appointed by the board to provide general civil engineering services for the county and to advise the board and county agencies in engineering matters.
COUNTY ROAD SUPERINTENDENT:
That official of Valley County appointed by the board whose duties are those of the county road superintendent and who is responsible for the administration of engineering (construction) matters on other county works.
COUNTY SURVEYOR:
The registered surveyor appointed by the board to check plats and make surveys, maps and plats as ordered by the board (and to advise the board and county agencies in matters pertaining thereto).
DEDICATION:
The setting apart of land or interests in land for use by the public. Land becomes dedicated only when accepted by the board as a public dedication, either by the passage of a county ordinance or by entry of a resolution of approval in the official minute book of the official meetings of the board, or by the recording of a plat showing such dedication.
DOMESTIC LIVESTOCK:
Including, but not limited to: cows, horses, llamas, rabbits, poultry and chinchillas on premises less than five (5) acres in size.
EASEMENT:
A grant of the right to use a parcel of land for specific purposes.
EXISTING STREET:
A street or road that is on the official road name list, has been accepted by the board of county commissioners, or approved by the board of county commissioners to be added to the official road name list.
HOUSEHOLD PETS:
Three (3) or less adult dogs and/or three (3) or less adult cats and other household domestic animals, and including their offspring under six (6) months of age.
LOT:
A portion of a subdivision intended as a unit for transfer of ownership or development.
ORIGINAL PARCEL:
A lot in a platted subdivision or a tract of land of record at the time of the adoption of the subdivision regulations on April 29, 1970, as evidenced by a parcel number having been assigned by the Valley County assessor.
OWNER:
The individual, firm, association, syndicate, partnership, or corporation having sufficient proprietary interest in the land to be subdivided to commence and maintain proceedings under this title.
PATHWAY:
Any sidewalk, route, lane, path, corridor, open space, or trail designated to move people by nonmotorized means for transportation or recreation. Nonmotorized does not include snowmobiles.
PLAT, FINAL:
The plan of the plat, subdivision or dedication, or any portion thereof, prepared for recording by the Valley County recorder and containing those elements of requirements set forth in sections 10-3-3-2 and 10-3-3-3 of this title and applicable sections of state law. After the Valley County recorder has recorded the final plat, it shall thereafter be known as an authorized plat, subdivision or dedication.
PLAT, PRELIMINARY:
A preliminary plan of the plat, subdivision or dedication containing the elements and requirements set forth in sections 10-3-2-2 and 10-3-2-3 of this title.
PRIVATE ROAD RIGHT OF WAY:
Privately owned land for a private road system.
PUBLIC RIGHT OF WAY:
Any land dedicated and open to the public and under the jurisdiction of a public highway agency.
PUBLIC ROAD:
Road, thoroughfare, alley, highway or bridge under the jurisdiction of a public highway agency.
REPLAT:
A plan of a resubdivision, altering an existing plat or portion thereof, complying with the requirements of this title and applicable laws of the state of Idaho and prepared for filing for record with the county recorder.
ROADWAY:
That portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of sidewalks, shoulders, berms, and other portions of the public or private right of way.
SHALL:
The word “shall” is used when an action is mandatory.
SIDEWALK:
A pedestrian walkway with permanent surfacing, constructed to county standards.
SIXTEENTH OF A SECTION:
A nominally square forty (40) acre tract of land situated within a section per the description set forth in the “Manual Of Instructions For Surveys Of The Public Lands”, as published by the United States government.
STREET:
A public right of way or private parcel, and relative improvements, which provides vehicular and pedestrian access to adjacent properties. The term “street” includes highway, parkway, way, road, avenue, boulevard, lane, place and other such terms. Streets within Valley County are classified as arterials, collectors, local or other depending upon their function, level of service and condition.
   Alley:
Public access of limited use intended only to provide access to the rear or side of lots or buildings in urban districts.
   Arterial Highway:
Highway controlled and maintained by the Idaho transportation department.
   Cul-De-Sac Road:
A short local road having one end permanently terminated by a vehicle turnaround.
   Frontage Road:
Minor road parallel and adjacent to a major route that intercepts local traffic and controls access to the major route.
   Half Street:
A portion of the width of a street, usually along the edge of a subdivision where the remaining portion of the street will be provided in the adjoining subdivision.
   Local:
Road that provides direct access to residential, commercial, and/or industrial sites for local traffic movement and connects to minor and major roads or arterial highways.
   Loop Road:
Minor road with both terminal points on the same road of origin.
   Major Collector:
General term for a road including primary county roads that provide travel corridors between cities, recreational sites and industrial areas.
   Minor Collector:
Roadway that provides for traffic movement within neighborhoods and between major roads and local roads with occasional access to abutting property.
   Stub Street:
A short local street terminating at the subdivision boundary where the extension will be provided to the adjoining property.
SUBDIVIDER:
An individual, firm or group who undertake the subdividing of a lot, tract or parcel of land for the purpose of transfer of ownership or building development, and including dedication of streets or changes in street or lot lines.
SUBDIVISION:
The division of an original parcel of land by deed, mortgage, deed of trust, or contract of sale which: a) results in more than two (2) subparcels of the original parcel; or b) provides land for a new street, either on the perimeter or across any portions of a parcel of land; or c) the redivision of any lot or parcel that was divided from an original parcel as defined by the subdivision regulations for Valley County, Idaho, adopted April 29, 1970.
UTILITIES:
