§ 130.05 ENFORCEMENT.
   (A)   Before taking any enforcement action under this section, a law enforcement officer shall ask the apparent offender's age and reason for being in the public place.
   (B)   The officer shall not take into custody any minor under this subchapter unless the officer reasonably believes that an offense has occurred and that, based on any response and other circumstances, no defense in § 130.04 is present.
   (C)   In the event that the minor is taken into custody the officer shall thereupon notify the parent or guardian and the parent or guardian shall be deemed guilty of permitting a violation of this subchapter.
