(a) If any bicycle or motorized bicycle is found on a street or sidewalk of the Village without a license tag, with a mutilated or altered serial number or with no serial number stamped on the frame thereof, it shall be prima-facie evidence that such bicycle or motorized bicycle is being operated without proper registration. Such bicycle or motorized bicycle shall be impounded by the Police and held thereby until proper ownership is proven.

(b) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
