171.06 PROCEDURE FOR MINOR MISDEMEANORS NOT COVERED BY THE UNIFORM TRAFFIC RULES.
   (a)   The following procedure is hereby established for the Utica Mayors Court for all minor misdemeanor cases other than offenses covered by the Uniform Traffic Rules (These cases include, but are not limited to the offenses set forth on Exhibit A as attached to Ordinance 99-10.)
      (1)   In minor misdemeanor cases a law enforcement officer may issue a citation.
      (2)   The citation shall: contain the name and address of the defendant; describe the offense charged; give the numerical designation of the applicable statute or ordinance; state the name of the law enforcement officer who issued the citation; and order the defendant to appear at the stated time and place.
      (3)   The citation shall inform the defendant that, in lieu of appearing at the time and place stated, the defendant may, within that stated time, appear personally at the office of the Clerk of the Utica Mayors Court and upon signing a plea of guilty and a waiver of trial pay the stated fine and stated costs, if any. The citation shall inform the defendant that, in lieu of appearing at the time and place stated, the defendant may, within a stated time, sign a guilty plea and waiver of trial provision of the citation, and mail the citation and a check or money order for the total amount of the fine and costs to the Utica Mayors Court Violation Bureau. The citation shall inform the defendant that the defendant may be arrested if the defendant fails to appear at either the clerk’s office or the time and place stated in the citation.
      (4)   A law enforcement officer who issues a citation shall complete and sign the citation form, serve a copy of the completed form upon the defendant, and without unnecessary delay, swear to and file the original with the court.
      (5)   When a defendant fails to appear, the court may issue a supplemental citation, or a summons and warrant under Ohio Rules of Criminal Procedure Rule 4. Such supplemental citation shall be in the form described in subsections (2) and (3) above, but shall be issued and signed by the clerk and served in the same manner as a summons under Rule 4 of the Ohio Rules of Criminal Procedure.
      (6)   When the defendant appears but does not sign a guilty plea and a waiver of trial, the court shall proceed in accordance with its normal procedure.

   (b)   The following fine schedule is hereby established for the Utica Mayor’s Court for minor misdemeanors other than offenses covered by the Uniform Traffic Rules. This fine schedule shall be permanently posted in the place where violation fines are paid. The fine schedule for minor misdemeanors, other than offenses covered by the Uniform Traffic Rules is as follows: fines for all such misdemeanors: thirty dollars ($30.00). This is in addition to court costs, which shall hereafter be set by Order of Court.
