1333.01 REGULATING SIGNS IN THE PUBLIC WAYS.
   (a)   “Public Way” shall be defined as it is defined in the Utica Zoning Ordinance which definition reads as follows:
Public Way: An alley, avenue, boulevard, bridge, channel, ditch, easement, expressway, freeway, highway, land, parkway right-of-way, road, sidewalk, street, subway, tunnel viaduct, walk, bicycle path; or other ways in which the general public entity have a right, or which are dedicated, whether improved or not.
   (b)   Location of Public Ways are determined by the Licking County Engineers tax parcel maps.
   (c)   No sign shall be placed in, or above the Public Way including on utility poles, except for municipally owned signs and except for signs authorized by the Village Administrator or Police Chief for community events and programs. Such community events and programs shall be only those sponsored by nonprofit, public, educational, religious and charitable organizations.
   (d)   The Village Administrator or Police Chief may effect removal of any sign illegally placed within any public way within the Municipality. The Village Administrator or Police Chief shall hold sign for five (5) days. If the owner fails to contact the Village Administrator or Polcie Chief or claim the said sign within five (5) days, said sign may be destroyed.
   (e)   There will be a fourteen (14) day limit on any temporary sign put on the Village Public Way.
   (f)   Those wishing to place a temporary sign within the public way must apply for a Temporary Sign Permit with the Village Administrator or Police Chief at Village Hall. The Village Administrator or Police Chief shall have the power to approve or disapprove all or any requests for temporary signs.
   (g)   The maintenance of each temporary sign is the responsibility of the permittee; any sign not properly maintained shall be removed.
   (h)   Signs at an intersection will be limited to three (3) signs per 100 foot of frontage.
   (i)   Signs shall not exceed six (6) square feet in size unless approved by Village Administrator or Police Chief for special public events.
   (j)   Real estate signs will only be permitted in public ways under the following conditions: Signs will be permitted in front of the proeprty being sold. Temporary off site real estate signs that announce the date and time of a real estate open house will be permitted provided the signs be placed no earlier than 6:00 a.m. and removed four (4) hours after the conclusion of the open house. A maximum of one sign per open house is allowed at any intersection. All temporary real estate open house signs must contain broker contact information. All real estate signs can be no larger than six (6) square feet in size.
   (k)   The Village Administrator or Police Chief shall regulate and enforce the requirements of this section, and shall be in charge of issuing all sign permits.
   (l)   Signs Exempt from this Section.
      (1)   This section will exempt sandwich board or sidewalk signs which are movable, are not attached to the ground or surface, and are placed within ten (10) feet of front or rear door of a business or as approved by the Village Administrator or Police Chief.
      (2)   This policy will exempt any political signs which shall be allowed for forty-five (45) days before voting, with a limit of one sign per every 100 foot of frontage or per lot if lot frontage is less than 100 feet.
