151.04 HOLIDAYS.
   (a)    The Village shall observe the following paid holidays: New Year’s Day, Memorial Day, Independence Day, Labor Day, Veteran’s Day, Thanksgiving Day, the Day after Thanksgiving Day, Christmas Eve and Christmas Day.

   (b)   All full time employees shall also be entitled to a “Floating Birthday” holiday. The employees may request any day of the year other than the holidays listed in subsection (a) of this section as his or her “Floating Birthday” holiday; the employee must request the “Floating Birthday” holiday in writing at least ten days in advance of the proposed “Floating Birthday” holiday date and must submit this request in writing to his or her immediate supervisor. The supervisor then must notify the employee of approval or denial of the requested day. If a “Floating Birthday” holiday request is denied, the employee may request a different day as his or her “Floating Birthday” holiday. The “Floating Birthday” holiday is only to be used as time off; no overtime or holiday pay is to be given for this holiday.
         
   (c)   If any holiday other than the “Floating Birthday” holiday falls on a Saturday, it will be observed the preceding Friday. If any such holiday falls on a Sunday, it will be observed the following Monday.
   (d)   In order to be eligible for a holiday with pay other than the “Floating Birthday” holiday, an employee must work the scheduled work day immediately preceding and immediately following the observed holiday. Vacation days are considered “hours worked” for holiday pay eligibility. Only full-time employees shall be eligible for a holiday with pay.

   (e)    If a full-time employee works on a paid holiday other than the “Floating Birthday” holiday, that employee shall be paid at the rate of two and one-half times the regular rate, provided he or she has worked the scheduled days immediately preceding and immediately following the observed holiday. If the employee has not worked a scheduled work day either before or after, he or she shall be paid the regular pay. If a part-time employee works on a holiday, he or she shall be paid at the rate of one and one-half times the regular rate, provided he or she has worked the scheduled work days immediately preceding and immediately following the holiday. For purposes of the foregoing sentence, “the holiday” shall be the day identified in subsection (a) of this section and not a Friday or Monday preceding or following a holiday which falls on a weekend as provided in subsection (c) of this section. If the part-time employee has not worked a scheduled work day either before or after the holiday, that employee shall be paid the regular rate of pay. Any employee who substitutes for another employee scheduled to work on a holiday other than the “Floating Birthday” holiday shall be paid based on the regular rate of pay of the employee who actually works.
