1309.02 PERMIT; BOND.
   (a)    Any person, firm or corporation, desiring to start construction of a structure for dwelling purposes on a lot not having immediate access to a completed, paved roadway or street may apply to the Mayor for a permit therefor. If a permit is issued, it must be in writing and can only be issued by the Mayor, or his duly authorized representative, with consent of Council.
   (b)    Such permit may provide for the construction, replacement, or repair of any street or roadway, and shall state the location, description and specifications of work to be performed on the street or roadway, and the date by which such work must be completed. The authorizing authority may demand a bond from the applicant in the approximate amount of the cost for construction, repair or replacement of the street or roadway.
   (c)    If construction, repair or replacement is not completed according to the requirements and specifications contained in the permit, the Mayor, with consent of Council is authorized to cause a bond forfeiture and/or complete the street construction, repair or replacement and assess the costs to the tax duplicates of the owners of property abutting on the streets or roadway, on a per footage basis.
