(a) Establishment of Revenue System. A user charge shall be assessed to all users, according to their classifications, by the Village in accordance with the provisions of this chapter. The Village may, under applicable statutes of the State and Village ordinances, levy ad valorem taxes for general obligation bond principal and interest payments and any other purpose provided by law not related to the operation, maintenance and replacement of the works of the system.
(b) User Charge System.
(1) User classes. Each user shall be classified as residential, commercial, industrial, institutional or governmental in accordance with the definitions in Section 929.07
for each class.
(2) Budget and appropriation. The Village Administrator shall annually prepare an estimate of anticipated costs for each category or user charge, as outlined hereafter, for the forthcoming fiscal year. These estimates shall be made in the form of a rate ordinance and shall be proposed to Council for enactment in the manner provided by the Ohio Revised Code. Any change in user charges shall maintain proportionality among user classes. (Ord. 84-14. Passed 6-4-84.)
(3) Operation, maintenance and replacement charges. The unit charges for operation, maintenance and replacement shall be determined as follows:
A. The estimated annual operation, maintenance and replacement costs shall be apportioned to treatment, conveyance, collection and billing. The costs associated with billing shall be separated from all other O, M and R costs and charged to users according to subsection (b)(5) hereof.
B. The annual O, M and R costs for treatment, conveyance and collection shall be divided by the previous year’s total billable flow in 100 cu. ft. (estimated if not available). The unit charge obtained shall be the basis for user charges to all users of the Village sanitary sewer system. All users with a billable flow less than 500 cu. ft. per month shall pay a minimum charge per month. The minimum monthly charge for O, M and R shall be based on the unit charge obtained above.
C. In addition to the unit charge described in subsection (3)B. above, the Village may establish a per account charge, not to exceed five dollars ($5.00) per month, for the purpose of paying for operation, maintenance and replacement costs.

(4) Extra strength waste charges. For each industrial, commercial, institutional or governmental user discharging extra strength wastes, a surcharge for such wastes shall be levied in addition to any other charges using the following formula:

B = Concentration of BOD (mg/l) from user
Sc = Operation and maintenance cost for treatment of a pound of suspended solids.
S = Concentration of suspended solids (mg/l) from user
Vu = Volume contribution from user in 100 cu. ft. of billable flow per quarter.
The unit operation, maintenance and replacement cost for treatment of BOD and suspended solids are obtained by separating the annual operation, maintenance and replacement costs into the parameters of flow, BOD and SS using the percentage breakdown of fifty percent (50%) for flow, twenty-five percent (25%) for BOD and twenty-five percent (25%) for SS. The unit charges for BOD and SS are obtained by dividing the annual operation, maintenance and replacement cost for each parameter by the annual billable pounds for each parameter.
(5) Billing charges. A unit handling charge per bill to cover the cost of billing and collection shall be assessed against each user. The total administrative and overhead costs associated with billing and collection shall be determined by the Village Administrator. The unit handling charge is obtained by dividing the total administrative and overhead costs by the forthcoming year's estimated total number of bills.
(6) Additional charges. Additional charges shall be billed, as required for the following:
A. Actual costs incurred for user-requested samplings and analyses.
B. Actual costs incurred for special handling not provided for elsewhere in this chapter.
C. Actual costs incurred for wastewater monitoring of industrial users.
(c) Debt Service. The unit charges for debt service are obtained by dividing the annual debt service costs for waste treatment works by the previous year's billable flow in 100 cu. ft. (estimated if not available). All users with a billable flow less than 500 cu. ft. per quarter shall pay a minimum charge per quarter. The minimum quarterly charge for debt service shall be based on the unit charge obtained above multiplied by five.
(d) Wastewater Treatment Charges.
(1) Operation, maintenance and replacement charges. The basic wastewater treatment bill to be paid by all users of the Village sanitary sewer system shall consist of user charges for operation, maintenance and replacement using the unit charges from subsection (b)(4) hereof and user charges for billing from subsection (b)(5) hereof. The unit charges shall be applied to the user's billable flow. A minimum charge, as defined in subsection (b)(3)B. hereof shall be paid by all users with a billable flow less than 500 cu. ft. per quarter.
(2) Debt service charges. In addition to the basic wastewater treatment bill described in subsection (d)(1) hereof, wastewater treatment bills for all users shall consist of debt service charges using the unit charges described in subsection (c) hereof. A minimum charge, as defined in subsection (c) hereof shall be paid by all users with a billable flow less than 500 cu. ft. per quarter.
(3) Extra strength waste and additional charges.
A. In addition to the basic wastewater treatment bills described in subsection (d)(1) hereof, wastewater treatment bills for industrial, commercial, institutional or governmental users shall consist of extra strength waste surcharges as described in subsection (b)(4) hereof, if applicable.
B. Additional charges described in subsection (b)(6) hereof, shall be levied on users and identified on the wastewater treatment bill, if applicable.
(e) Wastewater Treatment Bill.
(1) Payment for services. All users of the sanitary sewer system must pay for wastewater treatment and collection services in accordance with this chapter. No user shall receive free services.

(2) Bill period. A bill shall be produced and submitted to each user and shall be payable monthly. In the event a sewer user does not obtain his water from the Village, or has his sewage metered, he shall be billed separately, at the same time and for the same period as water bills are rendered. (3) Payment of bills. All bills shall be payable by the 25th of the month in which it is mailed or otherwise delivered, but in no event less than fifteen business days after the bill is mailed and shall be paid at the office of the Clerk of the Village or his/her authorized agent.
(5) Delinquent bills.
A. Any bill not paid by when due shall be declared delinquent and an additional charge of ten percent (10%) of the amount of the bill shall be added thereto and collected therewith.
B. Should a bill still be delinquent thirty-three days after the date of billing, the bill will be handled in accordance with Section 929.06(b).
C. Nonreceipt of any bill described in subsection (d) hereof shall not release the user of liability for any of these charges. In any case where the user is responsible for the nonreceipt of the bill, the conditions herein described for late payment and penalties shall apply. In those instances where the Village is responsible for the nonreceipt of the bill, the Village may, at its discretion, grant the user an extension of the payment period and later payment conditions described herein.
