929.01 INTRODUCTION.
   (a)   Authority. This chapter is adopted under the authority granted by Ohio R.C. 715.40 and 3707.42.
   (b)   Title. This chapter shall be known as, referred to, or cited as the “User Charge and Sewer Use Ordinance for the Village of Utica, Ohio,” and hereinafter referred to as this chapter.
   (c)   Findings and Declaration of Policy. Council hereby finds that the requirements for the issuance of Federal grants and the acceptance of such grants by the Village under Title II of the Federal Water Pollution Control Act as amended, (Public Law 95-217, of the Clean Water Act of 1977) and the regulations of the U.S. Environmental Protection Agency, as promulgated in the May 12, 1982, Federal Register, Volume 47, Number 92, Part II, for the construction of waste treatment works to improve the quality of effluent discharges from the Village establish:
      (1)   The necessity of adopting a user charge system that would be proportionate to all classes of users and produce the revenue required to sustain the sewage collection and waste treatment system;
      (2)   The necessity of enacting regulations that control the use and inflow into waste treatment works.
   (d)   Purpose and Intent. The purpose of this chapter is to promote the public health, safety, prosperity, aesthetics and general welfare of the citizens of the Village and is designed to provide the legislative enactments required under Public Law 95-217, and applicable Federal regulations for the acceptance of construction grants to improve the quality of effluent discharges from waste treatment works. It is further intended to provide for administration and enforcement of this chapter and to provide penalties for its violations.
   (e)   Interpretation. In their interpretation and application, the provisions of this chapter shall be held to be minimum requirements and shall be liberally construed in favor of the Village shall not be deemed a limitation or repeal of any other power granted by the statutes of the State.
   (f)   Severability. If any section, provision or portion of this chapter is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of the chapter shall not be affected thereby.
   (g)   Repeal. All other ordinances or parts of ordinances of the Village inconsistent or conflicting with this chapter, to the extent of the inconsistency only, are hereby repealed.
   (h)   Effective Date. This chapter shall become effective January 1, 1985, after adoption by Council and publication or posting as provided by law.
