913.01 REMOVAL OF DEAD OR DANGEROUS TREES.
   (a)   The owner of any property bordering on a Village right of way, tree lawn, street, or alley (“abutting owner”) shall promptly remove all dead or dangerous trees located either on the owner’s platted or surveyed property or between the property line and the curb line of the street, which trees are of a size sufficient to pose a hazard to vehicular or pedestrian traffic in the event such trees or parts of such trees should fall.
   (b)   The Mayor or his designee shall cause a written notice to be given to such abutting owner having such a dead tree or trees. The notice shall order such owner to remove such tree or trees within ten days. The notice shall be furnished by certified mail, return receipt requested, or served personally.
   (c)   In the event such abutting owner fails to comply with the notice, the Mayor or his designee may cause the tree or trees to be removed, cause the Village to pay the expense of removing the tree or trees, and certify the cost to the County Auditor to be placed as a lien on the real estate of the abutting owner.
