905.08 BUILDING AND REPAIR OF CULVERTS.
   (a)   Before installing any driveway culvert or other culvert along a roadside ditch within the dedicated portion of any public street or right of way within the Village of Utica, the owner of the abutting property shall first obtain written permission from the Village Administrator to make such installation.
   (b)   If a residential property within the Village is in need of a new culvert, in a location within the dedicated portion of any public street or right of way, the owner of such property may request that the Village install a culvert at such location. If the Village Administrator determines that such a culvert is necessary for drainage, the Village shall install such culvert, and the owner of the abutting property shall be responsible for the costs of all materials used in installing such culvert.
   (c)   Every culvert pipe hereinafter installed in a public street in the Village shall be of plastic material. Other materials acceptable to the Village Administrator may be used, but the owner of the abutting property shall be responsible for any additional cost. Every culvert pipe hereinafter installed in a public street in the Village shall be at least twelve feet in length, and at least twelve inches in diameter.
   (d)   All culverts within the dedicated portion of any public street within the Village, which abut residential property, and which are necessary for access to such residential property shall be maintained by the Village. The Village shall keep such culverts clear and in repair, and shall replace existing culverts if necessary for drainage.
   (e)   Violation of subsections (a) and (c) hereof shall be a minor misdemeanor. Each day of offense shall be considered a separate violation. (Ord. 94-32. Passed 11-14-94.)
