(c) The Chief of Police may refuse to issue a permit to any person who has previously violated any provision of this chapter.
(d) Any person who conducts or attempts to conduct a home sale without first obtaining a permit as required pursuant to Section 751.03 of this chapter shall be guilty of a minor misdemeanor for the first offense, and shall be guilty of a misdemeanor of the fourth degree for each subsequent offense. Conducting or attempting to conduct a home sale without a permit shall constitute a separate offense for each day during which the person conducts or attempts to conduct a home sale without first obtaining the necessary permit.
(e) Any person who is aggrieved by a decision of the Chief of Police under subsections (a) through (c) may appeal to an Appeals Board which shall consist of the Mayor, Village Administrator, and the President of Council, or any representative appointed by a designated member of the Appeals Board to hear a particular appeal. The aggrieved person may appear before the Appeals Board and present evidence, information and arguments to support his appeal. The Chief of Police shall also appear for the purpose of advising the Appeals Board of the basis of his findings and to provide additional information if necessary. The Appeals Board shall then determine whether to uphold, modify or set aside the findings and action of the Chief of Police, and the decision of the Appeals Board shall be final. No appeal may be taken to the Appeals Board after the expiration of ten days, excluding Saturdays, Sundays and holidays from the date that the aggrieved person receives notification of the adverse action of the Chief of Police.
