No person, whether an exhibitor or nonexhibitor of a mechanical amusement device, shall knowingly exhibit or maintain a mechanical amusement device for play, operation or use when the mechanical amusement device is not in working order and condition as will furnish the amusement or entertainment for which it was designed or is represented, unless there is attached thereto a conspicuous and legible sign or warning containing the phrase "out of order" or words of similar import.
