331.36 SQUEALING TIRES, "PEELING," CRACKING EXHAUST NOISES.
   (a)   No person shall use any automobile, motorcycle or any other vehicle or engine, stationary or moving, or any instrument, device or thing so out of repair, so loaded or in such manner as to create loud, unnecessary or unusual grating, grinding or rattling or other noises.
   (b)   No person shall operate any motor vehicle, in a manner that the vehicle is so rapidly accelerated or started from a stopped position that the exhaust system emits a loud, cracking or chattering noise unusual to its normal operation, or the tires of the vehicle squeal or leave tire marks on the roadway, commonly called "peeling."
   (c)   Whoever violates this section shall:
      (1)   For the first offense in any one year be fined not more than one hundred dollars ($100.00).
      (2)   For the second offense in any two-year period following the first offense be fined not more than five hundred dollars ($500.00) but not less than three hundred dollars ($300.00); and
      (3)   For each additional offense in any two-year period be fined five hundred dollars ($500.00) and no portion of the fine may be suspended.
