149.15 APPOINTMENTS.
   (a)   Investigation of Applicants.
      (1)   On receipt of the list of eligibles for appointment of promotion certified by the Commission, the Director shall conduct or authorize an investigation as to whether the applicants possess the necessary standards of health, physical attributes and mental soundness to perform the duties and responsibilities of the position sought.
      (2)   The investigation may include a physical fitness examination, medical examination, psychological examination or psychiatric examination, polygraph examination, background investigation, personal interview or any other method necessary to ascertain the qualifications and ability of the applicant.
      (3)   If the applicant is found during the investigation to be unqualified or unsuitable for the position, the Director shall notify the Commission of such rejection and the reasons therefor.
      (4)   If an additional name is to be certified to replace the person rejected, the Commission shall approve the reasons for such rejection. The Commission need not approve the rejection if no additional name is requested to be certified. When Commission approval is sought, the person against whom objection is made may be granted a hearing by the Commission if requested within three days after the notice of rejection is received.
   (b)   Permanent and Promotional Appointments. When the investigation of the certified eligibles is complete, the Director may appoint or promote those persons selected from the eligible list by the investigation procedure. The Director shall notify the Commission in writing of such appointment or promotion. Appointments or promotions may be made only to authorized positions.
   (c)   Temporary Appointments.
      (1)   Part-time and temporary employees may be appointed by the Director by noncompetitive examination from a list maintained by the Director for such positions.
      (2)   Part-time and temporary employees may be dismissed at any time and do not have the same rights and privileges as permanent classified employees.
   (d)   Provisional Appointment. When it is urgent that an immediate appointment be made to fill a vacant authorized position, and no eligible list exists for the position, the Director may take a provisional appointment to that position. Prior to such appointment, the Director shall notify the Commission, which shall approve the appointment. Among sworn officers of the Police and Fire Divisions, provisional appointments may be made only by appointing the next lower available rank to fill such position. In no case shall a provisional appointment continue longer than 120 days, or until an appropriate eligible list is established, whichever occurs first.
   (e)   In time of extreme emergency which poses a threat to public health, safety or welfare, and it is necessary to employ one or more persons, the Director may, without consulting the Commission, appoint a qualified person during the period of emergency, but in no case for a period exceeding fifteen days. Emergency appointments, with the reasons therefor, shall be reported to the Commission as soon as possible after the action is taken, but in any event, within three days. The Commission may inquire into the nature of the emergency and reject the appointment if it is found that no emergency exists.
