1321.01 DEFINITIONS.
         For purposes of this chapter, the following words and phrases shall have the following meanings ascribed to them respectively:
         (a)    "Swimming pool" means any structure or container either above or below grade, building or structure, designed to hold water to a depth greater than twenty-four inches when filled to capacity or having a water surface greater than 150 square feet, intended for emersion of the human body, whether for swimming or wading or both, by the occupants thereof and guests as an accessory use to a single or multifamily residence.
         (b)    "Fence" means any structure composed of wood, iron, steel, stone or brick erected in such a manner and position as to enclose either the pool area or property, sufficient to make such body of water inaccessible to small children. Such enclosure or fence shall be not less than five feet in height, measured from the level of the ground where located, which shall be of such design and construction as to effectually prevent a child from crawling or otherwise passing through or under such a fence. All gates shall be not less than four feet in height and shall be equipped with self-closing and self-latching devices placed at the top of the gate.
