(a) When a person or legal entity causes the surface of any public right of way in the City to be opened or excavated for the purpose of installing, repairing or connecting to a public utility line, the person or legal entity shall restore the public right of way per City Construction Standard 1167.16. The restoration of the public right of way shall be completed satisfactorily within thirty days of opening or excavating the public right of way. An extension may be granted by the City Engineer for weather conditions, construction, or other approved delays.
(b) When the restoration is not completed within the permitted time, or when the restoration is completed but not completed per the Construction Standards, the City has the authority to restore the public right of way per the Construction Standards and recover the expenses from the cashier’s check or performance bond. When the City must restore the public right of way, the City may charge an administrative fee, as determined by the Board of Control, to recover the administrative expense of the City’s involvement in restoring the public right of way.
