(a) A vacancy in the position of full-time Chief of the City Fire Division shall be filled by promotion from among persons holding the rank of captain and volunteer firemen holding a certificate complying with standards set by the State and/or the City for volunteer firemen, have at least five years service as such volunteer firemen, and have a rank of lieutenant or above in the Volunteer Fire Department. The position of Chief of the City Fire Division shall be filled by a person who has passed a competitive promotional examination. No competitive promotional examination shall be held unless there are at least two persons eligible to compete. After such examination has been held and an eligible list established, the Civil Service Commission shall forthwith certify to the Department of Safety or other appointing officer as provided for in Section 8.05 of the Charter of the City, the three persons having the highest rating; or if there are only two persons having taken the promotional examination then those two persons shall be certified to the appointing authority. Upon such certification, the appointing authority may appoint one of the persons so certified within thirty days from the date of such certification.
(b) In any appointment of a full-time Fire Chief, the applicant:
(1) Must be a resident of the City;
(2) Must be at least five feet six inches tall;
(3) Must be an American citizen or declare intent of becoming an American citizen;
(4) Must be of good moral character;
(5) Must pass a Civil Service exam for full-time Fire Chief.
