(A) Any person, firm, association, business entity or other organization, who shall cause or contribute to the cause of a hazardous incident within the confines of the township, shall be liable to the township for the cost of special equipment, materials and labor used to control and/or extinguish such incidents.
(B) The term HAZARDOUS INCIDENT shall refer to the release of any substance or material in any form or quantity which poses an unreasonable risk to safety and health and to property when transported in commerce.
(C) The special equipment and materials used in such hazardous incidents shall be deemed to include, but not be limited to, foam, dry chemical extinguisher, sand, the labor cost of fire and special police personnel and any other item deemed necessary by the personnel of the fire company in charge of controlling and/or extinguishing the hazardous incident.
(D) The personnel of the fire company in charge shall promptly forward a bill of costs for such special equipment and materials to the township, who shall bill the responsible party or parties. If payment is not received within 30 days from the date of said billing, then the township shall forward the matter to its Solicitor for collection.
