§ 50.99 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   (1)   Penalty. Any person violating any of the provisions of §§ 50.01 through 50.08 shall, upon conviction before a District Justice, be subject to a fine of $600, together with the costs of prosecution and/or imprisonment of not more than 30 days. Every violator of the provisions of §§ 50.01 through 50.08 shall be deemed guilty of a separate offense for each and every day until such violation shall continue, and shall be subject to the above penalty imposed by this section for each and every such separate offense.
      (2)   Additional remedies. In addition to the foregoing penalty, the township may require the owner or occupant of a property to remove any accumulation of solid waste and should said person fail to remove such solid waste after ten days following written notice, the township may cause the solid waste to be collected and disposed of with the costs for such actions to be charged to the owner or occupant of the property in a manner provided by law.
      (3)   Abatement. The imposition of the penalties herein prescribed shall not preclude the township from instituting appropriate actions or proceedings to prevent the violation of §§ 50.01 through 50.08, to restrain, correct or abate any such violation, or to prevent any act, conduct, business or activity constituting a violation.
   (C)   Any person, other than a municipal official exercising his or her official duties, who violates any provision of §§ 50.20 through 50.27, any resolution enacted, hereunder, any order issued hereunder or the terms or conditions of any contract awarded in the implementation of §§ 50.20 through 50.27 shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 and not more than $1,000 and costs and, in default of the payment of such fine and costs, to undergo imprisonment for not more than 30 days.
   (D)    Any person or entity violating the rules and regulations for the use of the yard waste facility as set forth in § 50.40, including the rules and regulations promulgated thereto and/or operating outside the permitted hours of operation, shall be subject to criminal prosecution, and upon conviction thereof, shall be deemed guilty of a summary offense, be sentenced to a term of imprisonment which shall be fixed by the Court at no more than 90 days and/or fined an amount not to exceed $1,000 per violation. In addition, any person found guilty shall be directed to make restitution to the township, be responsible for all reasonable attorney fees and expenses incurred by the township as a result of the prosecution, and be responsible for all costs of prosecution.
