§ 93.01 PARK RULES AND REGULATIONS; CONDUCT.
   (A)   Upland Community Building rules. Upland Community Building Rules, which are attached to the ordinance codified herein, are hereby incorporated and adopted by this section as the rules and regulations for the Upland Community Building.
   (B)   Park hours. All parks will open at 7:00 a.m. and close at 10:00 p.m. Any supervised event which continues after 10:00 p.m. shall be entitled to continue until the conclusion of the event without violation of park hours established herein. The Town Council may grant authorization for supervised events to be held at town parks or other properties owned by the town on dates and hours established by resolution.
   (C)   Alcoholic beverages and illegal substances. No person shall be in possession or under the influence of any alcoholic beverages or illegal substances within the town parks.
   (D)   Preservation of property and natural features. No person shall injure, deface or disturb any real estate, nor any building, sign, equipment, owned by the town and no other property or minerals may be removed, injured or destroyed. Vandalizing and intentional destruction or damage to park property and to any improvements located on park property is a crime which shall be referred to the County Prosecutor and the town will pursue recovery of the cost of the repair and replacement from the offender.
   (E)   Hunting and molesting wildlife. No person shall hunt, pursue with dogs, trap or in any other way molest any wild bird or animal found within the confines of the parks, or therein rob or molest any bird nest or take the eggs of any bird.
   (F)   Fires. No person shall start a fire on town property, except for food prepared in park grills. Privately-owned grills may be used in areas adjacent to shelter houses only. All fires shall be put out by the person, or persons starting or using the same before leaving the immediate vicinity of the fire. The dumping of hot ashes or fire from portable grills onto the grass or plants is prohibited.
   (G)   Littering. No person shall drop, cast or spill litter on park property, except in receptacles provided for such purpose.
   (H)   Camps. No person shall establish or maintain any camp or other temporary lodging place on park property without a permit from the Council.
   (I)   Disorderly conduct. No person shall, either by word or act, indulge in any noisy, boisterous, disorderly or indecent conduct; or in any manner to disturb the peace or good order of the community within the parks, nor shall any person engage in any active game endangering other persons in the parks; nor shall any person partake in any form or gambling, drink intoxicating liquor, or be drunk, or do any indecent lascivious, lewd or improper act therein.
   (J)   Traffic.
      (1)   No person shall drive or propel, or cause to be driven or propelled, along or over any road within the parks, any vehicle at a greater rate of speed than ten mph. Paths established for pedestrians and non-motorized vehicles shall not be used by motorized vehicles.
      (2)   No person shall park any motor car, motorcycle or other vehicle within the parks, except in places designated for parking.
   (K)   Commercial enterprises and solicitation. No person shall sell or offer for sale any article, thing, privilege or service within the parks or make any solicitation without a permit from the Council.
   (L)   Commercial advertisement. No person shall distribute or place commercial advertisement within the parks, without a permit from the Council.
   (M)   Dogs and cats. No dog, cat or any animal destructive to wildlife is permitted in the parks unless such animals are controlled at all times on a leash not more than eight feet long.
   (N)   Firearms, fireworks, explosive devices and weapons. No person shall possess or discharge any firearms, fireworks, explosive devices or other weapons, within the parks without a permit from the Council.
   (O)   Damage to park property. Intentional or negligent destruction, vandalism or damage to any park, property or to any improvements located within any park is a crime which shall be referred to the County Prosecutor and the town will pursue recovery of the cost of the repair or replacement from the offender.
   (P)   Definition of terms. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      PARK. Any land owned or controlled by the Town Council.
      PERSON. Includes persons and corporations.
