This chapter shall apply to all special flood hazard areas within the jurisdiction of the city. Nothing in this chapter is intended to allow uses or structures that are otherwise prohibited by Chapter 155 or state specialty codes.

(A) The area of special flood hazard identified by the Federal Emergency Management Agency in its flood insurance study (FIS) for the city dated December 15, 1978, with accompanying flood insurance rate maps (FIRM) or digital flood insurance rate maps (DFIRM), are adopted by reference and declared a part of this chapter. The FIS and the FIRM are on file at the office of the City of Union at 342 S. Main Street, Union, Oregon, 97883.
(B) Areas of special flood hazard are depicted on FIRMs and DFIRMs as special flood hazard areas (SFHA). When the base flood elevation has not been identified, the best available information for flood hazard area as identified in § 153.53 shall be the basis for regulation.

Pursuant to the requirement established in O.R.S. Ch. 455 that the city has a joint management agreement with the Union County Building Department who administers and enforces the state specialty codes, the city does hereby acknowledge that the state specialty codes contain certain provisions that apply to the design and construction of buildings and structures located in special flood hazard areas. Therefore, this chapter is intended to be administered and enforced in conjunction with the state specialty codes.

In the interpretation and application of this chapter, all provisions shall be:
(A) Considered as minimum requirements;
(B) Liberally construed in favor of the governing body; and
(C) Deemed neither to limit nor repeal any other powers granted under state statutes, including state specialty codes.

The degree of flood protection required by this chapter is considered reasonable for regulatory purposes and is based on scientific and engineering considerations. Larger floods can and will occur. Flood heights may be increased by man-made or natural causes. This chapter does not imply that land outside the special flood hazard areas or uses permitted within such areas will be free from flooding or flood damages. This chapter shall not create liability on the part of the city or any officer or employee thereof, or the Federal Insurance Administration, for any flood damages that result from reliance on this chapter or any administrative decision lawfully made hereunder.
