(a) Purpose and Scope. The purpose of this section is to prescribe policy and instructions governing personnel matters in the Police Department.

(b) Policy. Personnel matters in the Police Department shall be governed by this chapter to the same extent as other employees of the City except as stated in this section, Section 153.10, and except to the extent that the provisions of this chapter conflict with a collective bargaining agreement, in which event the terms and conditions of the collective bargaining shall apply.

(c) Specific Provisions Not Applicable to Police Department Personnel. The following provisions of this chapter are not applicable to personnel of the Police Department:
(1) Section 153.02(d); procedures for overtime.
(2) Section 153.05; hours of duty.
(3) Section 153.06(e)(3).
(4) Section 153.06(e)(6), except such section shall apply to regular full-time personnel of the Police Department.
(5) Section 153.06(f)(2).
(6) Section 153.06(h); court leave.
(7) Section 153.06(i); military leave; and Section 153.06(j), funeral leave, except such sections shall apply to regular full-time personnel of the Police Department.
(d) Supervisor. The Chief of Police shall be the supervisor of all personnel for the Police Department for the purpose of the implementation of this section.

(e) Types of Personnel. The Police Department shall be composed of three types of personnel:
(1) Regular full-time personnel. Regular full-time personnel are those employees who are employed full-time and as their main job and occupation with the Police Department. Generally, those personnel shall have the same privileges and working conditions as other full-time employees of the City. However, because of the special nature of their police duties and the special consideration in scheduling working hours, such matters as overtime pay, holidays, pay for holidays, basic work week, additional pay for Saturday and Sunday, additional pay for being called for duty not during regular time and court leave will be controlled by the provisions contained in this section rather than as set forth in the previous sections of this chapter.
(2) Regular part-time personnel. Regular part-time personnel shall be those employees who normally have a main and full-time occupation employment other than with the City and are merely serving on a part-time basis with the Police Department at such times as will not interfere with their full-time employment. These employees will be paid at their hourly rate for only the hours actually worked while performing such duties except as provided below. The City will not be expected to duplicate the benefits normally furnished by the full-time employer. These employees shall normally work not more than eighteen hours per week except in the case of emergencies. These employees shall not be entitled to sick pay, holiday pay, additional pay for working Saturday and Sunday, additional pay for being called for duty other than regular hours, court leave, military leave, funeral leave or pay therefor.
(3) Auxiliary Police Officers. Auxiliary Police Officers shall be those voluntary police officers who are not paid employees of the City. Auxiliary police officers are therefore not covered by this chapter except as to the provisions of this section pertaining to compensation for loss of pay due to court appearances.
(f) Overtime Pay and Procedures.
(1) Normal overtime duty.
A. The Chief of Police shall ensure that proper controls are established for the use of overtime. No overtime will be directed unless approved.
B. Before requesting overtime, the requesting official must determine that the need for additional manhours cannot be met through regular employee hours.

C. Except as provided below, regular full-time employees of the Police Department shall be paid overtime on the basis of one and one-half times the normal hourly rate for each hour worked which the employee is directed to work in excess of forty hours per calendar week, but only in accordance with the authorization as provided in these personnel regulations for overtime. In computing such forty hours of work, only the actual hours on duty and performing work shall be counted towards the forty hours of standard work. Pay received for holidays, compensatory time provided for court appearances, court appearance when not on pay status shall not be counted towards the forty hours of work. Regular full-time, part- time and auxiliary employees of the Police Department shall be paid time and one-half the normal hourly rate for each hour worked which the employee is directed to work during the holidays identified in Section 153.05.

D. Part-time employees shall not be entitled to overtime pay except as provided above. Part-time employees shall not be worked more than eighteen hours in any calendar week, except in an emergency, but in no event more than forty hours in any calendar week. (Ord. 814. Passed 12-1-87.)
(2) Court time. A full-time employee who is required to appear before a court, legislative committee, judicial or quasi-judicial body as a witness in response to a subpoena to testify concerning work-related matters shall be compensated for all hours at the applicable rate of pay, but in no event less than two (2) hours.

(g) Hours of Duty.
(1) Full-time employees. Regular full-time employees shall work an uncommon tour of duty. Such employees shall work a scheduled forty hours work week which shall include Saturday and Sunday as regular work days. The Chief of Police shall schedule such uncommon tour of duty for the full-time personnel.
(2) Part-time personnel. Part-time personnel shall not work a scheduled work week but only as called and scheduled by the Chief of Police. These employees shall normally be scheduled for work on Saturdays, Sundays, holidays and at other hours which will not normally interfere with their main and full-time employment. These employees shall not normally work more than eighteen hours per week, except in an emergency, but in no event shall these employees work more than forty hours in any calendar week.
(3) Scheduling for educational purposes.
A. Employees shall not be paid or compensated for attending school or a training course including the basic police training (294 hours) course.
B. The Chief of Police shall make such necessary variation in the scheduled work week to permit employees to attend school and training courses including the basic training course during their off- duty hours. Not more than two employees of the Police Department shall attend any such school or training course including the basic police training course at a given time.
C. No additional payroll costs will be incurred as a result of such rescheduling or the attending of such school or training course.
(4) Rest periods and lunch hours. Rest periods and lunch hours shall not be scheduled for personnel of the Police Department but they shall work a straight shift unless otherwise scheduled by the Chief of Police. Such personnel may have lunch while on duty providing they do so without interfering with the performance of their duties.
(5) There shall be no holidays in scheduling the work week in the Police Department. Part-time employees shall not be entitled to any holidays or holiday pay. Regular full-time employees shall be paid for the ten annual holidays on a straight time basis. Such pay shall be included in the pay check for the period in which the holiday occurs. Supervisors, including the Chief of Police, shall be paid on a straight time basis, for any holiday which they are required to work as a result of scheduling of the work week, in lieu of compensatory time off. Holidays shall be New Year’s Day, Presidents’ Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans’ Day, Thanksgiving Day, Christmas Day and employee’s birthday.
(h) Annual Leave.
(1) Full-time employees shall be entitled to the same annual leave as other employees of the City.
(2) Part-time employees. Regular part-time employees shall earn annual leave at the rate of 3.1 hours per 80 hours actually in a pay status excluding hours in court appearances.
(i) Sick Pay.
(1) Full-time employees. Regular full-time employees shall be entitled to the same sick pay as other employees of the City.
(2) Part-time employees. Regular part-time employees shall not be entitled to sick pay.
